In America, we have due process.

Every human in The United States is entitled to Due Process. The Fourth Amendment to the U.S. Constitution prohibits unreasonable searches and seizures. This means the government generally needs a warrant based on probable cause to conduct a search or seizure. 

the 5th Amendment of the U.S. Constitution applies to non-citizens, including immigrants and undocumented individuals, in the same way it applies to citizens. The key phrase in the Fifth Amendment, "No person...", means that the protections apply to anyone within the jurisdiction of the United States, regardless of their citizenship status. This includes the right to due process, protection against self-incrimination, and other fundamental rights.
